In consideration of the services of Grand Rapids Circus Project and their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf, I at this moment agree to release, indemnify, and discharge Grand Rapids Circus Project, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows.

#1 - I acknowledge that my participation in aerial arts training and instruction, including flow arts, aerial fabric and other disciplines entail known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks cannot be eliminated without jeopardizing the essential qualities of the activity.

The risks include, among other things: exposing its participants to the potential for slips and falls and falling; carpet burns; pinches; scrapes, twists and jolts that could result in scratches, bruises, sprains, lacerations, fractures, concussions, or even severe life-threatening hazards; strains, sprains, cuts, bruises, muscle soreness, and fractures; musculoskeletal injuries including head, neck, and back; injuries to internal organs; the negligence of other people; my own physical condition; and the risk of emotional and psychological injuries or physical damage associated with this activity. Traveling to and from shows, classes, and exhibitions raise the possibility of any manner of transportation accidents. In any event, if you or your child is injured, you or your child may require medical assistance at your own expense.

Furthermore, Grand Rapids Circus Project instructors and volunteers have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of the participant’s fitness, medical conditions, or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment used might malfunction.

#2 - I expressly agree and promise to accept and assume all of the risk existing in this activity. My participation in this activity is purely voluntary, and I elect to participate despite the risks.

#3 - I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Grand Rapids Circus Project from any and all claims, demands, or causes of action which are in any way connected with my participation in this activity or my use of Grand Rapids Circus Project’s equipment or facilities, including any such claims which allege negligent acts or omissions of Grand Rapids Circus Project.

#4 - Should Grand Rapids Circus Project or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and expenses.

#5 - I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I represent that I understand the nature of this activity and that I am qualified, in good health, and in proper physical condition to participate in such activity. I understand that any health problems such as heart conditions, high blood pressure, pregnancy, and conditions where being upside-down is contraindicated, and others not listed will not be allowed to participate in these activities without a written doctor’s approval. I acknowledge that if I believe conditions are unsafe, I will immediately discontinue participation in the activity. Knowing this, I certify that I am willing to assume the risk of any medical or physical conditions I may have.

#6 - In the event that I file a lawsuit against Grand Rapids Circus Project, I agree to do so solely in the state of Michigan, and I further agree that the substantive law of Michigan shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

#7 - I understand that my participation in a Grand Rapids Circus Project class, related event, or activity could increase the risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending Grand Rapids Circus Project activities and use of the facilities and equipment in the facilities could increase my risk of contracting COVID-19, even in well-ventilated and outdoor settings. I understand Grand Rapids Circus Project cannot guarantee that I or anyone else will not become infected with COVID-19.

I understand and voluntarily accept and assume all the preceding risks related to COVID-19 and also accept sole responsibility for any injury or illness that may occur in connection with my attendance at Grand Rapids Circus Project. Further, I understand and agree that this is a release of liability. On behalf of myself, my heirs, executor, administrators, successors, and assigns, I hereby release, covenant not to sue, discharge, and hold harmless Grand Rapids Circus Project and its owners, employees, agents, or representatives of and from the Claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Grand Rapids Circus Project, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Grand Rapids Circus Project activity.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Grand Rapids Circus Project on the basis of any claim from which I have released herein.

In consideration of Minor being permitted by Grand Rapids Circus Project to participate in its activities and to use its equipment and facilities, I further agree to indemnify and hold harmless Grand Rapids Circus Project from any and all claims which are brought by, or on behalf of Minor, and which are in any way connected with such use or participation by Minor.

I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.

BY TYPING YOUR AND YOUR MINOR'S NAME (“MINOR”) INTO THIS FORM, YOU ARE AGREEING TO THE USAGE OF A DIGITAL SIGNATURE TO BE BOUND BY THE ABOVE TERMS OF THE GRAND RAPIDS CIRCUS PROJECT PARTICIPANT AGREEMENT, RELEASE, AND ASSUMPTION OF RISK.
